Fixed-Wage Contract Validator (Korea)

LIVE

Check if your fixed-wage employment contract is legally valid under Korean labor law. Auto-compute shortfall and generate a certified notice.

About this tool

Fixed-Wage Contract Validator (포괄임금제 체크) checks whether your Korean fixed-wage employment contract is legally valid in light of the 2024 Supreme Court ruling (2020Da270503). Enter your base pay, fixed overtime, fixed night-shift, and fixed holiday allowances, and the tool computes the shortfall against actual hours worked. It then drafts a Korean certified mail (내용증명) you can download as a PDF and send to demand back-pay. Useful for IT, design, R&D, and logistics roles where employers often justify uncompensated overtime by saying "your fixed-wage covers everything." All calculations run in your browser; no salary or company data leaves your device.

Use cases

Scenario 1

Software engineer missed overtime

A backend engineer doing 30h/month overtime is told "everything is covered." Compute the shortfall vs. actual hours at 1.5× and produce evidence for a back-pay claim.

Scenario 2

Design agency weekend work

For weekend work in a design agency, automatically apply the 1.5× or 2× holiday surcharge and surface unpaid holiday allowances in under a minute.

Scenario 3

R&D night shift

For R&D shifts between 22:00–06:00 in pharma/semiconductor labs, separately credit the 0.5× night-shift surcharge above the fixed-wage cap.

Scenario 4

Logistics & call-center shifts

For rotating shifts blending holiday and night premiums, compute composite surcharges and prepare evidence for labor-board complaints or civil action when the shortfall is large.

Scenario 5

Final review before resignation

Before resigning, run a 3-year audit of past payslips, total any unpaid allowances, and self-assess whether sending a certified notice now is the right move.

Frequently asked

Q. Are all fixed-wage contracts invalid?
A. No. They can be valid for hard-to-measure roles when the worker is not disadvantaged. The 2024 Supreme Court held, however, that any shortfall above the fixed-wage cap must be paid separately — and this tool focuses on computing that shortfall.
Q. Can I send the result directly to my employer?
A. The drafted certified notice can be sent via Korea Post’s electronic certified-mail service or printed and mailed. Review the amount and cited provisions once more, and consult a labor attorney for high-stakes cases.
Q. Is my salary data safe?
A. All computation happens locally in your browser. No salary, hours, or employer information is ever sent to a server. Closing the tab clears the inputs.
Q. Can I file a labor-board complaint right away?
A. If the employer ignores the certified notice, you can file a wage-arrears complaint with the Ministry of Employment & Labor or pursue a civil payment-order petition. The tool’s output can be attached as evidence.
Q. Does it cover unused annual-leave pay?
A. The current version focuses on overtime, night, and holiday surcharges. For unused-annual-leave or severance, pair it with the Korean Payslip Generator tool.
